Panel of the Board

The Executive Committee may establish a Panel of the Board to conduct a review of a project.
In general, Panel reviews would be conducted to assess projects that:

  • Have potential significant adverse effects;
  • Are likely to cause significant public concern;
  • Involve the use of controversial technology; or
  • Other levels of assessment have been unable to come to a recommendation.

A Panel of the Board is comprised of Board members as set out in YESAA.

Panel Review process

1. Executive Committee establishes a panel by completing these administrative steps:·

  • Conduct a sufficiency check of the Statement. EC may request additional information from the proponent before it can say the Statement is sufficient.
  • Determine the composition of the panel by looking at where likely significant adverse effects might primarily occur and seek views from select participants.
  • Seek and views from select participants on a proposed terms of reference. Finalize the terms of reference that will provide instructions to the panel.
  • Select the panel members from existing members of the board and provide notice that the panel has been established.

2. The Panel completes a review of the proposed project, and the process includes some unique processes not seen at other levels of assessment in YESAB. It will:

  • Set up a process for intervenors to participate more formally in the process.
  • Conduct a technical analysis of the proponent’s Statement. This is an opportunity for intervenors and the proponent to make information requests of each other, and members of the public will be invited to comment on the Statement.
  • Hold public hearings on various topics related to the proposed project. Intervenors can make presentations to the panel and question other presenters. Members of the public may also choose to give a presentation.
  • Prepare a recommendation for the decision bodies. This recommendation can either be accepted or referred back to the panel once for further consideration.
